well lads, a question for ye....
if u have previously overstayed your holiday visa in america and are looking to head back there on holiday what are the chances of getting through customs?
i have a new passport since the last time i went and i`m just wondering if that makes any difference at all.....
would appreciate any info/help

Not sure but I`d imagine the serial numbers on the passports will be linked in some database so if you use your new passport details of other passports held may come out. In this case you should probably ring the embassy for advice. If you have time it may be possible to get a visa and not rely on the visa waiver scheme/Discretion of immigration official. Having said that I haven`t a clue. Ring up embassy as Mr. John Smith outline your circumstances and see what they say.

My query is completely different but I`ll throw it on the same thread to save on e-paper.
How easy is it for people with degrees etc to get visas to spend a year or so working in the states?
Can you get sponsored by a company over there or do you just need one of those morrison visa things?

Afaik your gonna have to hold your hands up on this one and serve the ban. Cousin of mine overstayed by one day and they stopped him, another friend had to go to the embassy to get the ball rollin on his ban so he could get back in. New passport won`t be worth a monkeys and the change to an irish name doesn`t help anymore either.

Not easy at all gola,the only way to get a job over there is getting sponsored which is extremely difficult no matter how many degrees you have unless you are really needed there. Also costs US companies an awful lot to sponsor foreign workers, the gaovernment dont want them by and larage and so make it difficult. As far as i know morrison visas were a once off about 20 years ago.

As for laaaaarge bottles, did you overstay your 3 month summer there during college?! Dont know but i guess you might not get in

Go over for the summer on a J1, updete  your CV, get a suit, and see what you can do while you`re there about getting interviews with companies that might be willing to sponsor you. A degree would help but at least a year or two of experience on top of that is going to strengthen your case. H1B visas can be hard to come by, but if you`re in the right industry then there are companies that would be willing to have you since H1B employees are usually cheaper than the locals  (at least at first ) , often are better educated, and are more inclined to do what they`re told since their life in the US hangs on the thread of their sponsorship.

Other than that you might have to just enter the green card lottery and hope for the best. The odds of winning that are a lot longer these days than they used to be.

LB, You have given me a reason to tell a story which may be of no use to you but was a lifesaver for me and my family some years ago. I had overstayed my visitors visa whilst doing more than visiting during my stay in the US. I was married at the time and was returning to bring the family over. I feared that the Immigration stamp showing that I had overstayed would prevent our entry, I set about asking the travel agents in langer land what would they suggest I do, well one of them suggested that I purchase flights to Florida and on to Disney, I had 3 young children and the perception was that the good old American values of the Immigration officials would trump any other concerns and we would be welcomed through. As the plane descended to American soil my wife and I were clearly apprehensive, we had sold our home and all our belongings to become part of the sad statistic of the flight from Ireland. When we landed and were been lined up to go through the visitors entry my daughter who was nine went into acting mode, she started wailing and slipped to the floor thrashing about in "pain" we were quickly surrounded by paramedics, immigration officials and everyone and anyone who thought they could help, she explained to them that she needed to get out of the building to get relief from the pain in her ears and this should be done quickly or it would get worse. Fair play to the security for deciding that our family should be rushed through the citizen entry point where the immigration official was not at all pleased but went along with it, they provided a limo for a journey to the other side of the Airport to catch our flight to Florida, when we were in the limo my daughter turned to me and winked saying " did I do good". What a girl, she had acted on what she knew needed to be done. Youll never beat the Irish for inginuity and expecially my daughter. You too can get creative!

I only know one lad who overstayed his visa, he got stopped the next time, got a right grilling in the interrogation room and got a 10 year ban. He thought the passport as gaeilge would mean he was a cert to get through, a nasty shock.

I would not chance it, they probably have a record of your overstayed holiday visa and it will come up on their systems as soon as you present yourself at immigration. Since 9/11 the Americans have become very paranoid about security. I know one girl who overstayed her holiday visa by a day, anytime she goes to America now she has to apply to the American embassy to get some sort of special visa before hand to allow her entry to the States.

I`m in the same boat Laaarge Bottles. Was as legal as cocaine back in the late 90`s until I came home. Would love to go back, Mrs. Lockes is hankering for a long weekend in NY. My 10 years is up next year but wouldn`t mind finding out if I could go back before then.

Those Americans are mad, friend of the fathers went to get a visa there a while back. Went up for the questioning and whatever then half way through they go why do you hate America??? He was like what are ye talking about???
They pulled out a black and white photo from when he was in college at Dublin and at an anti vietnam protest like twenty years before  (Scary to think they have the technology to do that kind of s**h ) 
Anyways they said he was anti American and told him to fup off.

How mad is that Ray????

thanks for the info lads.
stayed a few days over the 90 eight summers ago when i was a student, didnt think it was a big deal back then but it has turned into a major pain in the bum now!
greenandwhite, u a have given me a little glimmer of hope anyway with the fact that that girl you know gets a visa from the US embassy and manages to travel over and back. any more info on that out there i wonder

Companies can sponsor you for a H1B visa, thats lets you stay for 4 years and you can get extensions. The problem with these is that there is a quota, which is usually filled with in the first couple of months in the year.

If you can work in a college or university, it`s a bit easier to get one as there is no quota for educational purposes.

It took about 9 months to sort out my H1B back in 2004. Plenty of paperwork and a trip to the embassy was involved. When i had it there was no hassle getting in and traveling back home for holidays etc.

A guy I work with was going to New York with his wife for their 25th anniversary. Never been to the States in their lives. Immigration in Shannon wouldn`t let him on the plane because his name, John Ryan  (! )  was on the no-fly list.

They fully accepted that he was probably not the John Ryan that was banned but it was Saturday night, Washington was closed and couldnt confirm it so no-go. They also interrogated  (that would be the correct word )  for about an hour, separated from his wife who was distraught throughout the whole debacle.

Then they told him to come back Tuesday! Not a word about his hotel bookings or time off from work. They let them fly in the Tuesday, no problem.

If there is any doubt I would be checking with the US Embassy in avance. Give them all your proper details and get clearance / told to f**y off in advance. Why give yourself the stress of wondering are you going to get out or not? If you can`t go you can`t go. Theres plenty of better places to see in the world.

If you dont mind me asking dublinhell, what line of work were you in on your H1B visa and did you just apply for a job or did you have a contact in the company you worked with?

I overstayed my visa in 2004/5. was over there for 11 months altogether. Have been back there in Feb 06 and 07 for Superbowl weekends on the same passport with no bother. It seems to be all look of the draw. One thing I`d advise is not to book for a long holiday. looks better if you`re only going for a weekend or a few days. If wanting to go for a lengthy holiday I`d advise changing flights when you get there. Be ready for whatever questions they might ask you and also a letter from your employer stating you have a permanent job here is always useful.

In relation to the visa. I tried this last year and the H1B visa is the only visa you can get to go working and there is a quota of these which have been snapped up on the 1st day for the last couple of years. I spoke to an emmigration attorney over there and he advised that the "easiest" way to get a visa nowadays is to invest/buy a business. The H1B is a bit of a Holy Grail at this stage

I know a guy that stayed too long and was stopped when trying to go back. He got a 10 year ban  (which was lifted by a girl in emigration that he knew )  but he still had to go to the American Embassy in Dublin to apologise. They still wouldn`t let him in. What about flying through the UK or Canada?
