Friday May 09 2008

Waterford bus driver John O`Brien has been acquitted of his wife`s murder in October 2006.

The jury of seven men and five women returned their unanimous not guilty verdict after five hours and 10 minutes.

The 41-year-old, of Ballinakill Downs, took the unusual step of giving evidence himself as part of his defence

He insisted he had no hand, act or part in the 35-year-old`s murder.

Meg Walsh`s body was recovered from the River Suir two weeks after she went missing on October 1st, 2006.

She died as a result of blunt-force trauma to the head after she was struck at least twice with a heavy object.

She went missing after she and her husband had words because she had kissed Owen Walsh, who they had been drinking with overnight.

The State told the jury that there were certain gaps in the case as where and when she was murdered was not known.

They also said that when and how she was put into the river remained a mystery, something only the murderer would know.

The court heard that O`Brien, who told Gardai he was a wife-beater, assaulted Meg Walsh 11 days before her disappearance.

She went to the Gardai, but said she would not be pressing charges at that stage.

O`Brien told the court during the week that he was transferring ownership of the house into her name to prove it wouldn`t happen again.

The jury`s not guilty verdict was greeted by gasps throughout the court.

Meg Walsh`s daughter Sasha broke down in her seat and was comforted by Meg Walsh`s brother.

Pointless commenting on it, nobody knows the real story only the woman who died.
Also Posh is right, its the people on the periphial who will be the most hurt. Believe a father of someone heavily involved died during trial also.
Wait for the TV3 doc in 6 years time i`d say.

No he didn`t - it might be a bit tasteless, but he certainly didn`t say that!

What little I heard of the case struck me as very illustrative of the out of control, paranoid life that heavy drinking leads to.

Sign of the times.

Indeed, it was a case soaked in alcohol.

The other thing that struck me was how he had been convicted in the court of public opinion, led by the tabloid press.

I expect lots of outraged coverage over the weekend.

If he didn`t kill her, who did?

What was that about the two sets of keys?

I don`t think "mare" is a proper way to refer to any woman, not least the innocent victim of a killing.

You won`t get it. He has been cleared and that`s that. To suggest otherwise is to risk contempt of court.

TV3 ran footage of an extremely libellous part of her brother James` statement outside the courts earlier, and it was noticeable RTE didn`t follow suit. I doubt you`ll see said part in any of tomorrow`s papers either.

A travesty of justice in the four courts today.

I know quite a bit about one of the two party`s involved in this case and their family, im not going to say anything on a mesage board though. But as Limerick Nomad said, if he didnt do it, who did.

I had to go to the Land Registry in the Four Courts on Wednesday morning and went into Court 2 afterwards and followed proceedings for most of the rest of the day in the John O`Brien case. First time ever in a court. Saw both prosecution and defence closing speeches.

From what I saw in the closing speeches, I wouldn`t have convicted him on the evidence that was there. I did think he`d get done mind you because the Joe O`Reilly and Brian Kearney case seemed to be a case of having to prove your innocence regardless of how flimsy the evidence.

A journalist I got talking to was saying it was the same prosecution team of Senior Counsel Denis Vaughan Buckley and Dominic McGinn as in the other two cases. Looks like a master stroke by the defence barrister Paddy McCarthy to get O`Brien into the box. By all accounts the prosecution were caught completely on the hop, didn`t do a great job cross examining him and he held up fairly well.

Nomad the bit about the 2 sets of keys is that her car came with 2 sets of keys. If she did drive off on her own as alleged then how did both sets of keys come to be in the house? Who returned the set she drove with when she died? Or was it as alleged she had a 3rd set cut?

Haven`t really been following this case but saw a news paper report of the instructions the judge gave to the jury before sending them out to deliberate, and if the report is accurate then I`m not surprised he was aquited, there was enough doubt raised in the judge`s instructions.

Agree with you chrish, saw the judges statement aswell, certainly raised a few eyebrows from a lot of people ive been talking to. I know the judge has to be careful and all regards warning jurys these days with the amount of media intrusion, and the circumstantial evidence etc. But it seems to me he has frightened the jury into this verdict. That was a very strong worded statement of caution from him and I think has certainly swayed their verdict.

seems unbelievable that he got away with it given all the, albeit circumstantial, evidence.
He had motive, lied to the police, was seen on cctv walking where her body was found and told police he was somewhere else, car was spotted on cctv very close to where she was killed, had admitted to gardai that he beat her up.
There was the same type of evidence as convicted Joe O`Reilly.

The prosecution "blew it" going for a murder conviction as the
jury had then to come back with a unanimous decision?
